Legal Basis

The USA E2 Visa program is established under the legal framework provided by USA law, specifically paragraph 101(a)(15)(E) of the Immigration and Nationality Act (INA). This legislation outlines the guidelines and requirements for granting non-immigrant visas to foreign investors from treaty countries who wish to enter the United States to develop and direct the operations of an enterprise in which they have invested, or are actively in the process of investing, a substantial amount of capital. The E2 Visa provides a pathway for investors to reside in the USA and manage their business ventures, contributing to economic growth and fostering international business relationships. The Government determines, by Cabinet Decisions, which projects and which amounts of investment shall qualify as a “substantial investment” and thus lead to eligibility under the Citizenship-by-Investment Program.
